General Terms and Conditions (GTC)

These General Terms and Conditions (hereinafter: GTC) contain the conditions for the provision of website development services offered by GS Design Gombos Szilvia EV (hereinafter: Service Provider). The terms and expressions used in this document are defined as follows:

Client: A natural or legal person who orders the website development service provided by the Service Provider.

Service: The website development and related services provided by the Service Provider.

GENERAL PROVISIONS

1.1. For issues not regulated in this Policy and for the interpretation of this Policy, Hungarian law applies, with particular reference to the Civil Code (Act V of 2013) and the Act CVIII of 2001 on electronic commerce services and certain aspects of information society services. The mandatory provisions of applicable laws apply to the parties without the need for specific stipulations.

1.2. These GTC are valid from November 9, 2024, until further notice.

1.3. The Client is required to accept the provisions of the GTC during the ordering process.

1.4. Availability: The Service Provider does not maintain a separate customer service. The Client may contact the Service Provider by phone between 8:00 AM and 4:00 PM, or by email at any time with requests, questions, or complaints.

DATA PROCESSING RULES

1.5. The data processing practices are governed by the Data Protection Statement.

ORDERING AND PURCHASE PROCESS

1.6. The ordering process:

  • Calculation: The Client uses a calculator to select the desired features of the website, and based on this, receives the calculated fee via email.
  • Order: The Client can submit the order by accepting the offer and clicking the “Proceed to Payment” button on the order form.

Required information for the order:

  • Billing information: Last Name, First Name, Company Name and Tax Number (if applicable), Email Address, Phone Number, Postal Code, City, Street and House Number, Chosen Domain Name, Chosen Template Number.

Payment:

  • Via PayPal: The Client can pay using PayPal by logging into their PayPal account, or, if they don’t have an account, they can pay using a credit card on the PayPal payment page.
  • Installments: Payment can be made in three installments:
    1. First installment: 40% of the total amount upon order.
    2. Second installment: 40% upon the first round of checks.
    3. Third installment: 20% upon project delivery.
      Full access and training materials are available only after the full payment is made.

Scheduling and Submission of Materials: After placing the order, the Client selects the project start date and uploads the required texts and images on the form sent by the Service Provider. The date can be modified once.

If the Client does not submit the content and image elements by the deadline, the Service Provider will upload the texts and images free of charge within two weeks after project delivery. After this period, further updates will be charged at the current hourly rate (9,000 HUF/hour).

1.7. If a promotional price is introduced, the Service Provider will fully inform the Clients about the duration of the promotion.

1.8. The Service Provider must promptly confirm the order receipt electronically. If this confirmation is not received by the Client within the expected time frame, but no later than 48 hours after sending the order, the Client is released from the obligation to bind to the offer or contractual obligations. An order and its confirmation are considered received when they become accessible to the parties. The above rules may be modified by mutual agreement.

PROCESSING AND PERFORMANCE OF ORDERS

1.9. The order confirmation will be sent within 48 hours. The Service Provider will send the Service Agreement to the Client within this period. The order becomes valid upon the online confirmation of the agreement and the acceptance of the GTC and Data Protection Statement.

1.10. The performance deadline, which may vary depending on the service, will be included in the Service Agreement.

PROVISIONS ON HOSTING AND DOMAIN SERVICES

1.11. General provisions for hosting and domain registration are included in the GTC for these services.

CANCELLATION AND TERMINATION

1.12. The Client has the right to cancel the contract before the work begins. If the Service Provider has already started the execution of the order, cancellation is not possible, and the Client is required to pay the full service fee. In the case of cancellation, the fees for hosting and domain are non-refundable, but they become the Client’s property with a paid fee for one year.

1.13. The Client is not entitled to cancel the contract if the Service Provider has fully completed the service.

1.14. The Client is not entitled to cancel or terminate the contract for “products that are not pre-manufactured and are made according to the Client’s specifications or clearly personalized,” such as:

  • Domain name orders
  • Hosting services for the contracted period.

1.15. The procedure for exercising the right of withdrawal/termination:
The Client may exercise their right to withdraw or terminate the contract under the conditions specified in points 1.12-1.14 by sending a written request (via email) to the Service Provider. The Service Provider will refund the portion of the service fee due to the Client within 14 days following the settlement with the Client.

WARRANTY

1.16. The Service Provider offers a 1-month warranty on the website’s operation upon delivery and ensures that the website operates according to the agreed specifications. In case of warranty claims, the Client must immediately notify the Service Provider of the detected error. The Service Provider is obligated to correct the error.

1.17. The Service Provider does not offer a warranty for errors caused by the browser or the computer running it (hardware or software components).

1.18. The Service Provider does not assume responsibility for the content displayed on the website (texts, images, graphic materials). If the Client has ordered hosting services from the Service Provider, the Service Provider is entitled to remove infringing content immediately and without explanation and notify the Client via email. In case of serious legal violations, the Service Provider is entitled to suspend the hosting service.

COMPLAINT HANDLING

1.19. The Service Provider does not maintain a separate customer service. The Client may file a complaint by phone (+36-70-7747236), email (hello@gsdesign.hu), or mail (3711 Szirmabesenyő, Kölcsey Ferenc Street 84).

The Service Provider will start handling the complaints within 48 hours of receipt and will inform the Client of the outcome via email within 30 days.

OTHER PROVISIONS

1.20. Additional individual requests, such as the installation and configuration of modules requested by the Client, will be fulfilled by the Service Provider after completing the contract. These additional services will be charged separately according to the current development hourly rate (9,000 HUF/hour) or according to a prior quotation.

1.21. The Service Provider and the Client will try to settle any disputes peacefully. In case of unresolved legal disputes under this Policy, the Miskolc District Court will have jurisdiction by mutual agreement.
